Terms of Service

These Terms of Service (“Terms”) are a binding agreement between Atelier LLC (“Atelier,” “we,” “us”) and the business or person (“you,” the “Customer”) using the OnCall Trades service (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. The Service
OnCall Trades provides an AI phone receptionist that answers calls on your behalf, understands the caller, checks your availability, books jobs into your calendar, sends confirmations, and escalates to a human when it matters. Features may change over time as we improve the Service.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for the activity under your account, and for keeping your credentials secure. Notify us promptly of any unauthorized use.
3. Subscriptions, billing, and overage
The Service is offered on recurring subscription plans. By subscribing you authorize us and our payment processor to charge your payment method the recurring fee for your plan, plus any usage-based overage (for example, per-minute charges above your plan’s included minutes), on each billing cycle until you cancel. Fees are billed in advance; overage is billed in arrears. Except where required by law, fees are non-refundable. We may change pricing on prospective notice. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period.
4. Acceptable use
You agree not to use the Service to:
- violate any law or third-party right, or send unlawful, deceptive, or harassing content;
- place or facilitate calls or messages that violate telemarketing, TCPA, or anti-spam rules;
- attempt to disrupt, reverse engineer, or gain unauthorized access to the Service;
- resell or provide the Service to third parties except as expressly permitted.
We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure.
5. Call recording and SMS responsibilities
The Service may record and transcribe calls and send transactional SMS on your behalf. You are responsible for complying with all applicable recording-consent, wiretap, and messaging laws for your business and your callers, including providing any notices or obtaining any consents the law requires. Recipients can reply STOP to opt out of messages. See the Privacy Policy for how this data is handled.
6. Third-party services
The Service integrates with third parties such as Google Calendar, telephony and SMS providers, and Stripe for payments. Your use of those services is subject to their own terms. If you connect Google Calendar, you also agree to Google’s terms; our use of Google user data is described in the Privacy Policy and complies with the Google API Services User Data Policy, including its Limited Use requirements. We are not responsible for third-party services’ availability or acts.
7. Customer content and data
You retain ownership of your business data and call content. You grant us a limited license to process that data solely to provide and improve the Service consistent with the Privacy Policy. You represent that you have the rights necessary to provide it to us.
8. Intellectual property
The Service, including its software, models, and branding, is owned by Atelier and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.
9. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the AI will handle every call correctly. You are responsible for reviewing outcomes for your business.
10. Limitation of liability
To the fullest extent permitted by law, Atelier will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
11. Indemnification
You will indemnify and hold harmless Atelier from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law, including recording-consent and messaging laws.
12. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate the Service or your account for violation of these Terms, risk, or non-payment. On termination, your right to use the Service ends; data handling on termination is described in the Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, by additional notice. Continued use after changes take effect constitutes acceptance.
